Litter-Free Zones
La. R.S. 30:2544 relates to Litter Free zones and the placement of temporary signs, handbills, flyers and notices; notice to remove; and penalties.
The public rights-of-way of all state, parish and municipal roads, highways and streets are declared litter-free zones. Littering is defined to include the posting or displaying on any surface, pole or stanchion of temporary signs, handbills, flyers and notices, including but not limited to political signs.
By statute, the owner of a temporary sign, handbill, flyer or notice in a litter-free zone must be notified by certified mail indicating the location or locations of such item(s) and given thirty (30 days after receiving notice to remove thereof.
Failure to comply with such notice shall create a violation that shall be fined in accordance with the provisions of R.S. 30:2531(a), intentional littering. The fine for the first offense is $250 per violation.
