Notice of Termination


When the tenant has not breached the lease but the landlord chooses to not renew the lease when it expires, a Notice of Termination must be delivered to the tenant.

For a month-to-month lease, a written notice of termination must be given 10 days prior to the end of the month which the rent was paid.

If the term of the lease is longer than a month (ex. Year lease), the notice of termination must be given at least 30 days before the end of the lease period.

Additionally, if a tenant has not vacated after a notice of termination has been delivered and the lease has expired, the notice of termination serves as a notice to vacate and the landlord may file a petition of eviction with the court.
